To the extent of any conflict between the Terms and Conditions and any other Policies, the Terms and Conditions shall prevail.

GlobeScan and the University take your privacy very seriously and will use and protect any personal information you provide on this website in accordance with our Privacy and Cookies Policy.

7. User Submissions

Certain portions of the website may invite or enable you to post, upload, embed, display or otherwise communicate text, messages, photos, videos, sound recordings, music (including lyrics), graphics, drawings, suggestions, ideas (including product and advertising ideas), your and/or other persons' names, likenesses, voices, usernames, performances and other information, materials or content owned or created by you (collectively, "User Submissions").

GLOBESCAN AND THE UNIVERSITY WILL CONSIDER USER SUBMISSIONS AS NON-CONFIDENTIAL AND NON-PROPRIETARY AND SHALL BE UNDER NO OBLIGATION TO MAINTAIN THE CONFIDENTIALITY OF ANY INFORMATION CONTAINED IN YOUR USER SUBMISSION. 

You warrant and represent that you have (and will continue to have during your use of the website) all necessary rights, licenses, consents and permissions which are required to enable GlobeScan, the University and other participants to use your User Submissions for the purposes envisaged by the website and these Terms and Conditions.

You further warrant and represent that you have the consent, release, and/or permission of each and every identifiable individual in your User Submissions to use his or her name or likeness in the manner contemplated by the website and the Services or other materials on or available from the website.

In connection with User Submissions, you agree that:

(i) you will not submit any User Submission that is subject to any right of a third party including, without limitation:

1. copyright, patent, trade mark, trade secret, or other proprietary or contractual right;
2. right of privacy or publicity; or
3. confidential information

unless you are the owner of such rights or have permission from the rightful owner(s) to submit the User Submission and to grant the rights herein;

(ii) neither the User Submissions, nor the use of the User Submissions as permitted in these Terms and Conditions, will infringe upon or violate the rights of any person or entity or any applicable laws;

(iii) you will not submit User Submissions that are unlawful for you to possess in the country in which you are resident, or which it would be unlawful for GlobeScan and the University to use or possess in connection with the provision of the website or the Services; and

(iv) you will not submit a User Submission that:

1. is illegal or encourages or condones illegal acts or the discussion of illegal acts with the intent to commit them, including drug dealing, drug abuse, child pornography, physical or sexual assault, stalking, theft, fraud or conspiracy to commit a criminal act;

2. is defamatory, threatening, abusive, harassing or an invasion of privacy;

3. is discriminatory or prejudicial based upon race, color, religion, gender, sexual orientation, age, disability or otherwise;

4. is obscene, pornographic or otherwise sexually explicit;

5. is dangerous, irresponsible or antisocial or encourages or condones dangerous, irresponsible or antisocial behavior;

6. contains a virus or other harmful component, or otherwise impairs, interrupts or damages the website, the Services or any connected network, or otherwise interferes with a person's use or enjoyment of the same; or

7. contains any advertisement, solicitation, chain letter, pyramid scheme, investment opportunity or other unsolicited commercial communication.

You understand and agree that you are solely responsible for your own User Submissions and the consequences of your posting or publishing them.

In addition, you understand and agree that when using the website, you may be exposed to User Submissions posted and/or submitted by other users. GlobeScan and the University is not in any manner responsible for User Submissions, and does not guarantee the accuracy, integrity, quality or intellectual property rights of, or relating to, such User Submissions. In addition, GlobeScan and the University cannot assure that harmful, inaccurate, deceptive, offensive, threatening, defamatory, unlawful or otherwise objectionable User Submissions will not appear on the website.

Without limiting the generality of the foregoing, you acknowledge and agree that the information, materials and opinions expressed or included in any User Submissions are not necessarily those of GlobeScan and the University. GlobeScan and the University expressly disclaim any and all liability in connection with any User Submission. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against GlobeScan and the University with respect to any User Submissions.

By uploading User Submissions you understand that they may be available to the public and you agree not to assert in any part of the world any claim for invasion of privacy, breach of your rights under applicable data protection law or statute or appropriation of your right of publicity arising from or out of GlobeScan and the University's use of your User Submissions in accordance with these Terms and Conditions. You acknowledge and understand that GlobeScan and the University will consider User Submissions as non-confidential and non-proprietary and does not guarantee any confidentiality with respect to User Submissions.

8. Removal of User Submissions

Without prejudice to our other rights under these Terms and Conditions or at law, GlobeScan and the University reserve the right in their absolute discretion and without prior notice to refuse to post, exclude or remove any User Submission from the website that violates the Terms and Conditions and/or the Policies.

9. Identifying Users and Disclosing User Submissions to Third Parties

GlobeScan and the University will fully cooperate with any law enforcement authorities, court order or subpoena requesting or directing GlobeScan and the University to disclose the identity of anyone posting User Submissions. To the extent we can do so by law, we reserve the right to identify any user to third parties and/or disclose any User Submission or personal data to any third party claiming that a User Submission infringes their intellectual property rights or their right to privacy. We may also disclose such information if we believe in good faith that such disclosure is reasonably necessary to protect the rights, property, or personal safety of GlobeScan, the University or members of the public.

10. Moderation 

Although GlobeScan and the University are not under an obligation to review or monitor User Submissions, we reserve the absolute right to do so in our sole discretion. In addition, we reserve the right at all times to alter, edit, refuse to post or remove any User Submissions from the website, in whole or in part, for any reason or for no reason and without prior notice. You agree that GlobeScan and the University have no obligation to use or respond to any User Submission.

If you upload User Submissions to the website, or make contact with other users of the website, you must comply with the Code of Conduct.

11. Ownership and Use of Website Materials, Products and Services

With the exception of User Submissions, the University and GlobeScan jointly own the copyright and other rights for all of the material on the website or have a valid right from a third party to use material on the website. The University and/or GlobeScan also own or have a valid right to use all trademarks, service marks, graphics and logos used on this website. Unless expressly stated, no part of the website may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright, trade mark and other proprietary notices on the materials. 12. Ownership of User Submissions

You shall retain all your ownership rights in your User Submissions, but you are required to grant limited rights to the University and GlobeScan and other users of the website.

In return for using the website and the Services, you grant the University and GlobeScan a non-exclusive, irrevocable, worldwide, transferable license (with full right to sub-license) to use your User Submissions in any media format and through any media channel in perpetuity and free of charge. Such use shall include reproducing, copying, editing, adapting, making derivative works from, making available for download, synchronizing, displaying, publicly performing, transmitting, broadcasting, publishing, distributing, sub-licensing and deleting your User Submissions.

You agree that we may use your name to attribute your User Submission to you (although we shall not be obliged to do so).

13. License to Other Users of the Website
You also grant to each user of the website, a non-exclusive, worldwide license to access your User Submissions through and on the website free of charge, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions to the extent permitted on the website and by the functionality of the website and as envisaged by these Terms and Conditions.

GlobeScan and the University control and operate this website from the United States. All visitors to this website are responsible for compliance with all local laws applicable to them with respect to the content and operation of this website.

Online moderators will be available to guide the flow of the discussion covering a variety of topics to be agreed upon in advance of the event. 3. How we use your information

The basis for processing your personal information is the consent you gave when registering for the Global Corporate Affairs Council Collaboration Forum and your use of this website.

We use the personal data which you submit or which we collect to:

(a) enable your use of the Forum website, including by publishing any messages that you choose to submit onto the website. We or other users may choose to respond to your messages, or choose to try to interact with you via the website, as described at the time when we collect your information or as otherwise described to you prior to the use of your information;

(b) manage your use of the website, including for such issues as user support;

(c) generate reports and academic papers on the use of the website and on the Global Corporate Affairs Council Collaboration Forum as a whole. Such documents may include information that you have chosen to submit to us (including quotes, experiences, opinions, and audio-visual images), which may be attributed to you personally. Such documents and the underlying data can be used internally within GlobeScan and the University for their own purposes, but may also be shared with third parties (including academic institutions and policy bodies) for the purposes of drafting or reviewing such documents and/or for the publication of such documents, including via the Internet. Please do not submit any information that you consider to be sensitive or that you do not wish to see publicly attributed to you.

(d) Your contact information may be used to send you information on the outcome of the Global Corporate Affairs Council Collaboration Forum and on similar events in which GlobeScan participates in the future. It will not be used for other purposes without your express prior consent. 

(e) As noted above, please keep in mind that certain areas of our web site are interactive in nature and allow you to post information that other users can see. If you do not wish to have information viewed publicly, please do not use those portions of the website.

Information we collect about you from your use of our website

We will use this information in our legitimate interests, where we have considered these are not overridden by your rights:

  • To administer our site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes.
  • To keep our site safe and secure.

4. Our surveys and promotional updates and communications

Participation in surveys and forums conducted by GlobeScan and the University, and receipt of mailings generated by GlobeScan and the University, are entirely optional and at the discretion of the registrant, survey respondent or forum participant. You are always free to choose whether or not to participate in a survey, free to choose not to answer any specific questions and free to discontinue participation at any time.

Where permitted in our legitimate interest or with your prior consent where required by law, we will use your personal information for marketing analysis and to provide you with thought leadership or promotional update communications by email about our services.

You can object to further marketing at any time by checking and updating your contact details and preferences within your profile or selecting the “unsubscribe” link at the end of all our invitations, thought leadership and promotional update communications to you, or by sending us an email with “remove” in the subject line, indicating your full name and email address in the body of the message, to privacy@globescan.com.

You can also request that we send marketing or thought leadership material to a non-personal email address instead of one that identifies you as an individual.

5. Who we give your information to

We may share your personal data with:

  • Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, who support our processing of personal data under this policy. If any of these parties are using your information for direct marketing purposes, we will only transfer the information to them for that purpose with your prior consent.
  • Appropriate third parties including:
    • our clients, partners, suppliers and sub-contractors for the performance of any contract we enter into or other dealings we have in the normal course of business with you or the company that you work for;
    • our auditors, legal advisors and other professional advisors or service providers;
  • In relation to information obtained via our website:
    • analytics and search engine providers that assist us in the improvement and optimisation of our site and subject to the cookie section of this policy.

  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets subject to the terms of this privacy policy.
  • In the unlikely event that GlobeScan or the University are acquired by a third party, in which case personal data held by us about our Global Corporate Affairs Council members will be one of the transferred assets.

Without assuming any obligation to do so, we also reserve the right to collect and share any information we deem necessary to investigate or take action in connection with suspected fraud, illegal activities, possible harm to persons or property, to protect ourselves or one or more of our users or their heirs, or as otherwise required or permitted by law.

6. Where we store your information

For non-EEA residents:

Please note that in certain cases, your personal information may be transferred to processors, affiliated companies or third parties with whom we manage the Global Corporate Affairs Council Collaboration Forum, some of which may be located outside the United States of America in countries where the privacy laws may not be as protective as your jurisdiction. By using this site you hereby accept the transfer of your personal data in such cases.

For EEA residents:

7. How we protect your information

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, all information is kept behind suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

We inform our employees about our policies and procedures regarding confidentiality, security and privacy, and we emphasize the importance of complying with them. Our security procedures are consistent with generally accepted commercial standards used to protect personal information.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Data collected from market and social research studies are shared with our clients or partners in aggregate (or group) form, and responses are not attributed to individuals, in other words we combine your survey responses with the responses of all other survey participants and report aggregate responses.

We may transfer personal information to affiliated companies or non-affiliated service providers for research-related purposes, such as data processing (as detailed in the ‘Where we store your information’ section.) We require these companies to safeguard all personal information in a way that is consistent with our firm’s measures and as regulated by law. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

GlobeScan and the University shall maintain reasonable and systematic controls, schedules and practices for information and records retention and destruction which apply to personal information that is no longer necessary or relevant for the identified purposes or required by law to be retained. Such information shall be destroyed, erased or made anonymous.

Our website may, from time to time, contain links to external sites. We are not responsible for the privacy policies or the content of such sites.

8. How long we keep your information

The length of time we hold your personal information varies depending on the type of information and its use. We will retain your personal information on our systems only for as long as necessary to provide the services or information you have requested or for such other essential purposes such as complying with our legal obligations

Other personal data will be retained for up to 12 months from the time of last engagement with us, e.g., attending a webinar or forum, responding to a survey, opening an email.

We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our services. You cannot be identified from aggregate information retained or used for these purposes.

9. Your rights

You have the right under certain circumstances:

  • to be provided with a copy of your personal data held by us;
  • to request the rectification or erasure of your personal data held by us;
  • to request that we restrict the processing of your personal data (while we verify or investigate your concerns with this information, for example);
  • to object to the further processing of your personal data, including the right to object to marketing as mentioned in ‘Our survey promotional updates and communications’ section;
  • to request that your provided personal data be moved to a third party.

Your right to withdraw consent

Where the processing of your personal information by us is based on consent, you have the right to withdraw that consent without detriment at any time by contacting us. You can also change your marketing preferences at any time as described in ‘Our survey promotional updates and communications’ section.

How to exercise your rights

At any time, you may withdraw your consent; exercise your right to access, rectify and, as the case may be, delete any personal data relating to you, in compliance with applicable data privacy law, by sending a request to privacy@globescan.com or in writing to Privacy Officer, 145 Front Street East, Suite 208, Toronto, Ontario, Canada M5A 1E3.

If you believe that any information, we are holding on you is incorrect or incomplete, please write to or email us as soon as possible. We will promptly correct any information found to be incorrect. 

Without prejudice to any other administrative or judicial remedy, you shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to yourself infringes this Regulation.

GlobeScan and the University may update and revise this policy from time to time, review its Personal Information collection, use, and disclosure practices in order to assure compliance with laws and regulations.
